Appellants originally instituted suit against Woodrow Douglas Oil Company and appellee Phillips Petroleum Company, but took a non-suit against Douglas following the trial courts action in granting the summary judgment in favor of Phillips, thus making the trial courts order in such respect appealable as a final judgment.
